Terms of Service

1. The Service

Leadgen helps B2B teams discover prospects (currently via Google Maps via SerpApi), enrich them with publicly available data, manage them inside a CRM, and send outreach emails. The Service is provided as-is and may evolve over time.

2. Eligibility

You must be at least 16 years old and able to form a binding contract to use the Service. If you use Leadgen on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

3. Your account

You are responsible for keeping your login credentials confidential, for activity that happens under your account, and for the accuracy of information you provide. Notify us promptly at ashwanijha04@gmail.com if you suspect unauthorized access.

4. Acceptable use

You agree NOT to use Leadgen to:

• Send unlawful, harassing, defamatory, obscene, or hateful content.
• Send unsolicited bulk email in violation of applicable law (including CAN-SPAM, CASL, and the EU ePrivacy Directive). You are responsible for ensuring you have a lawful basis for each recipient.
• Impersonate any person or organization.
• Send malware, phishing, or fraudulent communications.
• Scrape data from the Service or reverse engineer it.
• Resell the Service without our prior written consent.
• Circumvent rate limits, security features, or quotas of integrated services (Gmail, HubSpot, SerpApi, Anthropic).

We reserve the right to suspend or terminate accounts that violate these rules or that pose a security or legal risk to the Service or others.

5. Your data

You retain all rights to the data you upload or that we discover on your behalf. You grant us a limited license to process this data solely to operate and improve the Service. See our Privacy Policy for details on data handling.

6. Third-party services

The Service integrates with third parties (Google, HubSpot, Anthropic, SerpApi, Supabase, Render, Vercel). Your use of those services is governed by their respective terms. We are not responsible for their availability, behavior, or pricing.

7. Fees

Some features may require payment in future. We will give you advance notice before any paid plan applies to your account. Today, the Service is provided without charge during early access. Usage limits may apply.

8. Intellectual property

The Service, including its software, design, logos, and content (excluding your data) is owned by us and protected by intellectual property law. These Terms do not transfer any of that ownership to you.

9. Termination

You can stop using the Service and request account deletion at any time. We may suspend or terminate your access if you violate these Terms or if continued operation of your account poses a risk to the Service or others. On termination, we will delete your data within 30 days unless we are required by law to retain it.

10. Warranty disclaimer

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH THE SERVICE. OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU HAVE PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR USD 100, WHICHEVER IS GREATER.

12. Indemnity

You will indemnify and hold us harmless from any claim, loss, or liability arising out of your violation of these Terms, your violation of applicable law, or content you send through the Service.

13. Governing law

These Terms are governed by the laws of India. Any dispute will be resolved in the courts of Bengaluru, India.

14. Changes

We may update these Terms. If we make material changes, we will give you reasonable notice (in-app or by email). Your continued use of the Service after the changes constitutes acceptance.
